We want your experience with us to be perfect and we have found it very useful inform you some of our policies in advance so to answer many common questions.
The client consents to be photographed by Divine Portraits by Patricia Carrozzini
Due to the fact that the demand for our services is high, an advance $100 of the cost of the services, Booking Fee is requested and required at the time of booking to secure your date and time of meeting.
The Booking Fee is non-refundable, but can be applied to a rescheduled session within one year max., and with a minimum of 5 days cancellation notice.
Order Cancellation or Variation:
Orders confirmed by the Client with Divine Portraits by Patricia Carrozzini are binding and cannot be cancelled, altered or otherwise changed, without the express agreement of Divine Portraits by Patricia Carrozzini. All changes, additions and variations are subject to additional charges.
Client is reponsible for reveiwing the spelling of all prints materials such as greeting cards. Divine Portraits by Patricia Carrozzini will not be responble for errors after the client has reviewed and approved proofs. if Reprint is required it will be the sole responsibility of the client to cover the reprint cost.
All the portraits will be displayed in a private online gallery, two to four weeks after the shoot.
Any changes to a Confirmed Order voids all (if any) discounts.
Reshoots will be treated as a new session and are subject to a session fee and the photographer’s availability. Furthermore, if a reshoot is requested the original images taken from the first shoot will not longer be available for viewing or purchase.
Vouchers cannot be used in conjunction with any other offer or voucher and are not redeemable for cash or any other goods, and may only be used as described there on. Vouchers are non transferable.
All photographic image files remain the property of Divine Portraits by Patricia Carrozzini at all times.
I hereby assign future copyright of my portraits photographs to Divine Portraits by Patricia Carrozzini. Copyright in all images produced by Divine Portraits by Patricia Carrozzini remains the exclusive property of Divine Portraits by Patricia Carrozzini
Divine Portraits by Patricia Carrozzini retains the exclusive right to make prints and reproductions of images it produces.
Marketing & Promotion:
Divine Portraits by Patricia Carrozzini may reproduce images from a client’s session for its own marketing, advertising, promotion and exhibition, both internally and externally.
No Commercial On-Sale:
Divine Portraits by Patricia Carrozzini shall not make any commercial sale of the images without the written permission of the Client.
Client’s Usage and Reproduction:
All prints and image files provided to the Client by Divine Portraits by Patricia Carrozzini are licensed for personal use only, and cannot be sold or reproduced without written consent.
To preserve our brand and the integrity of our work the client agrees not to alter any original images provided by Divine Portraits by Patricia Carrozzini. If the client requires any further cropping, altering, black and white adjustments or photo shop they will need to contact Divine Portraits by Patricia Carrozzini for permission or a quote for it to be done professionally. Screen shots are strictly prohibited and must not be displayed on social media unless it is the original copy of the image untouched or cropped.
Attendance & Delays:
In the unlikely event that the assigned Photographer is unable to attend your photo shoot due to unforeseen circumstances, Divine Portraits by Patricia Carrozzini reserves the right to appoint another photographer to attend on her behalf to undertake the photography to his / her best ability, or to reschedule the photo shoot to another agreed date.
Tardiness on the client’s part may result in reduced shooting time, which may result in less images presented by the photographer. The photographer cannot guarantee a time extension on sessions and will not cut into the shooting time of another session to make-up for lost time.
Photography of minors:
For subjects under the age of 18 at least one Parent or Guardian must be present at all times, and the Parent or Guardian must maintain a visual contact with the minor.
Photo sessions involve physical activity. This is undertaken at the client’s own risk.
Divine Portraits by Patricia Carrozzini prides itself on the very highest standards of printing, mounting, framing and reproduction. However, the manufacturing processes and use of third party suppliers may from time to time result in minor blemishes appearing on products that are beyond our ability to avoid or remove. An attempt to have these fixed will always apply. The client therefore agrees to accept such blemishes or faults that are deemed to be within reasonable tolerances by Divine Portraits by Patricia Carrozzini.
Limit of Liability:
Divine Portraits by Patricia Carrozzini takes the utmost care with respect to exposure, transportation and processing of photographs, including using professional grade equipment and professional grade backup equipment. However, in the unlikely event of the clientʼs photographs being lost, stolen or destroyed for reasons within or beyond Divine Portraits by Patricia Carrozziniʼs control, the latterʼs liability is limited to the return of all payments received for the event package. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
Although all the precautionary measures recommended by the CDC (Center for Disease Control and Prevention) will be taken so that the session takes place in the safest possible environment, when reserving you assume as your own the total and absolute responsibility of any risk to your health related to COVID19, you understand that under public health guidelines, the only safe and contagion-free place is your home, and that when crossing the door to the outside, any factor can be a risk of contagion. You agree to follow the processes that our studio has established for appointments, session development and product delivery.
If by government ordinance the session must be canceled or rescheduled, deposits will remain in effect until the session can be held. If due to the passage of time, the type of session contracted is no longer viable, the deposit made by the client will be valid to choose another type of session to be held when the authorities allow it.
This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. This Agreement shall be governed by the laws of the State of New Jersey.
